cosmetics27.com is an e-commerce site accessible via the Internet at www.cosmetics27.com (hereinafter "the Website"). It is open to any user of this network (hereinafter "User"). The Website is published by ME UNLIMITED, SARL with share capital of €109,762, APE code 20.42Z, whose registered office is located at 144 Avenue Charles de Gaulle 92200, Neuilly sur Seine, registered with the Nanterre Trade and Companies Register under number 502 460 371.
ME UNLIMITED offers for sale on the Website cosmetic products (hereinafter referred to as the "Products") to users browsing the Site (hereinafter referred to as "Customers"). For the purposes hereof, it is agreed that the Customer and ME UNLIMITED shall be collectively referred to as "Parties" and individually referred to as "Party". The Customer is understood to be a major natural person or who has at least the legal capacity to place an order on the Website for non-professional purposes. In this respect, the Customer's attention is particularly drawn to the fact that the order must not exceed a quantity of six items per reference. In the event of an order exceeding the quantity mentioned above, the order shall be considered null.
The Products sold on the Website are not intended for resale or distribution. We reserve the right to cancel orders and/or suspend accounts for which we believe that the products, due to their quantity, are ordered in violation of this provision. Any order for a Product offered on the Website implies consultation and express acceptance of these general terms and conditions of sale in their version in force at the time of the contract.
Any order implies prior consultation and acceptance of these general terms and conditions of sale by checking a box provided for this purpose during the purchase process.
The purpose of these general terms and conditions of sale is to define, worldwide, exclusively with regard to the relationships they establish on the Internet and only on the Website, the rights and obligations of the Parties arising from the online sale of the Products offered on the Website. These terms and conditions shall apply to the exclusion of any other document. They organise all stages necessary for placing the order and ensuring the follow-up of said order between the Parties.
II. Products - prices
The Products offered for sale by ME UNLIMITED are those presented on the Website, on the date of the Customer's consultation of the Website, within the limit of the available stocks and subject to the conditions stipulated in the preamble.
The Products presented on the website www.cosmetics27.com are offered for sale worldwide with the exception of certain countries for logistical reasons. In the event of an order to a country other than the EU countries, the Customer is the importer of the Product(s) concerned and shall take responsibility for the customs formalities and customs duties related to the import into its country. Photographs on the website www.cosmetics27.com are presented for illustrative purposes. Furthermore, the Customer is required to read the description sheet of each Product to find out the characteristics thereof.
The prices of the Products are indicated in euros, pounds and US dollars including taxes. They take into account the VAT applicable on the date of the order on French territory. The prices indicated do not take into account the packaging and delivery costs which will be invoiced in addition and will be specified to the Customer upon final validation of its order. Any change in the applicable rate may be reflected in the prices of the Products. The prices applied are those appearing on the Website at the time of the order. After that date, they may be amended at any time. THE UNLIMITED shall not be bound by the display of an erroneous price, obviously too low, regardless of the reason (computer bug, manual or technical error). In this case, ME UNLIMITED shall inform the Customer as soon as possible and the order will be cancelled.
The sale offers on the Website, governed by these general terms and conditions of sale, are valid for any Product as long as the latter remains online. These general terms and conditions of sale are deemed to be accepted by the Customer from the moment when the Customer ticks the acceptance box on the validation page of the Order and shall apply for the period necessary to deliver the Products.
IV. Registration and confirmation of orders
1. Browsing the Website
The Customer may discover the various Products offered for sale by ME UNLIMITED on its Website. The Customer may freely browse the various pages of the Website, without being required to place an order.
2. Registration of orders
If Customers wish to place an order, they will choose the different Products in which they are interested, and show this interest by clicking on the "ADD TO CART" box. This operation adds the product to "Your cart". At any time, Customers may:
- View a summary of the Products they selected or modify their order, by clicking on the icon "Your cart" accessible at the top right of each page;
- Continue the selection of Products by closing the "Your cart" tab;
- Complete the selection of Products and order them by clicking on "Checkout".
To order the Products chosen, the Customer will click on the "Your cart" icon. A summary of the order will appear on the screen and will specify the mention "Payment". If the list presented corresponds to the Products chosen, the Customer shall confirm the summary by clicking on "order".
3. Customer identification
The order can only be validated on the Website if the Customer has a member account.
For a first purchase, the Customer must identify by accurately filling out the form provided, on which the Customer shall include the information necessary for identification and in particular the surname, first name, postal address, telephone or optionally the date of birth. For the following purchases, the Customer will need to enter the e-mail address and password. Customers are informed and accepts that entering a user name shall be considered as proof of identity and indicate their consent. When this identification is made, a purchase order will appear on the screen, summarising: the nature, quantity and price of the Products selected by the Customer, as well as the total amount of the order, the Customer's contact details, the delivery address of the Products and the billing address. Customers are responsible for the choice and retention of their user names and password and shall ensure their confidentiality. ME UNLIMITED cannot under any circumstances be held liable for any theft of user names and password and logging into customer accounts by third parties. The provision of personal information collected in the context of the distance selling is mandatory, as this information is necessary for the processing and delivery of orders as well as for the preparation of invoices. This information is strictly confidential.
4. Final confirmation of the order
After reviewing the status of their order, and once all the information requested has been completed by Customers, Customers will click on the "Checkout" box to pay for the order.
At this stage, the Customer will be directed to a page indicating the billing address and delivery address that may be modified if necessary. Customers shall have the option to send a message of their choice for delivery. On the following page, Customers may choose the delivery terms and click on “Continue" (between Colissimo and Chronopost for delivery in France and DHL for export), Customers will then be able to proceed to a page allowing them to choose the method of payment, it being understood that Customers shall be able to proceed with the payment method as defined in Part 5 "Payment", below. The Customer will click on the button corresponding to the payment method selected. To do so, customers must confirm that they have read these general terms and conditions of sale by ticking a box "I accept the general terms and conditions of sale and adhere to them unconditionally. (Read the General Terms and Conditions of Sale)" to make the payment. Once the payment is validated, the purchase order shall be recorded in the computer registers of ME UNLIMITED, which are preserved on reliable and durable media, and shall be considered as evidence of the contractual relations between the Parties. After receipt of the confirmation email, the order may not be modified or cancelled, except for exercising the right of withdrawal or in cases of force majeure.
The price due by the Customer is the amount indicated on the summary purchase order which the Customer has taken note of before definitively validating the order (plus delivery costs that will be added in section concerning delivery). The price is then recalled following payment in the summary document sent by email to the Customer's email address by ME UNLIMITED. All payments must be made immediately via the Internet. Unless the server is unavailable, the Customer shall have the choice at the time of validation of the order as specified above, between the following payment methods:
- Online when placing the order by bank card ( Visa, Visa Electro, Mastercard, Maestro, American Express card is not accepted);
- Online when placing the order by PayPal: if Customers have a PayPal account, they can use it to pay their orders on the Website.
With regard to payment by bank card, the payment terms are as follows: Notwithstanding the application of article R.642-3 of the French Criminal Code, the Customer shall pay the order by bank card (card with CB sign, VISA, EUROCARD or MASTERCARD cards) in accordance with the provisions of this article. To pay for the order by bank card, the Customer will be automatically re-directed to the payment server of Banque Populaire. The Customer must send the bank card number to the Site, along with the card expiry date and the card security code (3 digit number on the back of the bank card). This data will be encoded on the servers on which the Website is hosted using the Secure Socket Layer (SSL) security standard in order to protect as effectively as possible all data related to the payment methods, and that at no time the Customer's bank data will pass through the IT system of ME UNLIMITED. The card will be debited at the time of the order. In any case, the amount debited corresponds to the Product(s) actually delivered. In any case, the online provision of the credit card number or any other method of payment and the final validation of the order shall constitute proof of the whole order, in accordance with the provisions of French law no. 2000-230 of 13 March 2000 adapting the law of evidence to information technology and relating to electronic signature reproduced in articles 1316 et seq. of the French Civil Code. They shall also constitute proof of purchase of the items appearing on the purchase order. This validation shall constitute signature and express acceptance of all transactions performed on the Site. 6. Order Tracking
To track the current order, the Customer can log in to the personal account by visiting the "My Account" / "History of orders and details" section and contact customer service by email or by phone for any information relating to the order.
V. Loyalty programme
ME UNLIMITED has implemented a loyalty programme allowing Customers to obtain price reductions on future purchases. For any order, the Customer will receive a loyalty point for 10 euros spent. The points shall be credited upon receipt of the Products. The Customer may transform these loyalty points into a price reduction for the next orders, each point being worth one euro. Loyalty points will be cancelled in the event of non-payment, withdrawal or cancellation of the order. These points cannot give rise to any form of payment of a sum of money. These loyalty points are kept by the Customer for a period of 12 months from their date of receipt, a date after which they can no longer be used and will therefore be lost.
The order shall be delivered no later than fifteen (15) days from the day following that of the Customer's validation of the order, including the time required to process the order and the shipping time. ME UNLIMITED shall do its utmost to ensure that the order is shipped within an average of 3-4 working days and a maximum of 6 working days from the day following payment of the order. Unless one or more Products are unavailable, the Products ordered shall be delivered at the same time.
1. Unavailability of products
The Products are offered subject to availability. In the event of unavailability of any of the Products, ME UNLIMITED shall reimburse the value of these items by bank transfer. In all the above mentioned cases, the Customer may cancel the order by requesting either the reimbursement of the sums paid within fourteen (14) days at the latest after the sums are withdrawn, by e-mail to email@example.com, or the exchange of the unavailable Product(s).
2. Delivery methods
Customers may, at their option, be delivered the Product at their address or at another address. The Products ordered by the Customer shall be delivered to the address indicated by the Customer on the purchase order. In the event of non-delivery due to the recipient of the Products being absent, the carrier shall leave a non-delivery notification in the mailbox of said recipient allowing the latter to recover the package during the working hours of the Post office/deposit office, within fifteen (15) days. The Products shall be shipped:
- For France, by the standard postal services, and in particular by means of the "Colissimo suivi" service according to postal delivery times or by Chronopost, which undertakes to deliver the products within 24 hours. Delivery is free of charge for orders exceeding 200 euros including tax.
- For the European Union and outside the European Union, via DHL Express. Delivery is free of charge for orders exceeding €200/$200/£200 including tax.
Upon receipt of the Products ordered, the Customer shall verify the conformity of these Products. Any anomaly concerning the delivery (missing or broken product, damaged package, etc.) must be notified by the Customer on the receipt submitted by the delivery agent at the time of delivery of the package and must be notified, on the same day of receipt or at the latest on the first business day following receipt, to the customer service of ME UNLIMITED by email sent to firstname.lastname@example.org or by telephone at +33 (0)1 84 16 23 62 from 9am to 6pm GMT from Monday to Friday (cost: current price). Any claim made after this deadline shall be rejected and ME UNLIMITED shall be discharged from any liability. Any non-compliant Product, to be exchanged or refunded, must be returned to ME UNLIMITED in its original packaging and containers, accompanied by the invoice, to the following address: ME UNLIMITED - 144 Avenue Charles de Gaulle 92200, Neuilly sur Seine. It is specified that the shipping costs shall be borne by ME UNLIMITED. ME UNLIMITED shall then exchange or reimburse the defective or missing Products.
VII. Right of withdrawal
Customers has a period of fourteen (14) working days to exercise their right of withdrawal if they are not satisfied with the Product(s) ordered. This period starts from the day of delivery of the order. Customers must return, at their expense, the Product(s) ordered within fourteen (14) working days from the exercise of the right of withdrawal. The Product(s) must be returned in its/their original packaging and containers, together with the invoice and the completed withdrawal form, at the following address: ME UNLIMITED - 144 Avenue Charles de Gaulle 92200, Neuilly sur Seine.

ME UNLIMITED shall provide the Customer with an acknowledgement of receipt of the withdrawal to the email address indicated at the time of creation of the account. If the above conditions are met, ME UNLIMITED shall reimburse the Customer, within fourteen (14) days, the sums corresponding to the products acquired by the Customer and the standard delivery costs (this does not include any additional costs if the customer opted, where applicable, for a delivery method other than the least expensive "standard delivery" offered by ME UNLIMITED. ME UNLIMITED shall carry out the reimbursement using the same method of payment as the Customer has used for the initial transaction (unless the Customer has expressly agreed to an alternate method of payment). However, in the event of a full or partial payment per loyalty point, it is specified that they cannot be repaid and will be credited to the customer's loyalty account. In accordance with the provisions of article L.221-28 of the French Consumer Code, regarding the opening of cosmetic products resulting in making these products unfit for any subsequent marketing, the Customer has no right of withdrawal or any cosmetic product that has been opened, damaged, or whose original packaging has been unsealed, shall not be refunded, taken back or exchanged for hygiene and health protection reasons. Consequently, Customers are informed that they will not be entitled to assert their rights of legal withdrawal on said products.
1. Legal guarantees
All products offered for sale on the Website benefit from the legal guarantee of conformity (as defined in articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (as defined in articles 1641 et seq. of the French Civil Code), allowing the Customer to return defective or non-compliant products free of charge, provided that the use thereof has been normal.
a. Legal guarantee of conformity
When bringing an action based on the legal guarantee of conformity, the Customer: :
The return costs will be borne by the Customer and will only be reimbursed if ME Unlimited is liable under the guarantee.
Article L. 217-7 of the French Consumer Code:
« Any lack of conformity which has become apparent within 24 months from the date of delivery of the items shall be presumed to exist at the time of delivery, unless proved otherwise. For second-hand items, this period is set at six months. The seller may challenge this presumption if it is not compatible with the nature of the item or the alleged lack of conformity. »
Article L.217-5 of the French Consumer Code:
« To comply with the contract, the item must:
1° Be appropriate for the use normally expected for a similar item and, as the case may be:
- correspond to the description given by the seller and possess the qualities that it presented to the Buyer as a sample or model;
- present the qualities that a buyer may legitimately expect with regard to public representations made by the seller, the producer or by its representative, especially in advertising or labelling;
2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the Customer, brought to the attention of the seller and which the latter has accepted. " »
Article L.217-12 of the French Consumer Code:
« The action resulting from the lack of conformity is time-barred two years from the delivery of the item. »
b. Warranty against hidden defects
The Customer may decide to implement the warranty against hidden defects of the item sold within the meaning of Article 1641 of the French Civil Code. In this case, the Customer may choose between the cancellation of the sale or a reduction in the sale price in accordance with article 1644 of the French Civil Code.
Article 1641 of the French Civil Code:
« The seller is bound to the warranty on account of hidden defects in the thing sold that renders it unfit for the use for which it was intended, or which so impairs this use that the Customer would not have acquired it, or would have given a lesser price for it, had he known of them. »
2. Consequences of the implementation of guarantees
As part of the legal guarantee of conformity, ME UNLIMITED undertakes, at the Customer's choice:
- Either to replace the product with an identical product based on available stocks;
- Or to reimburse the price of the product if the replacement of a product proves impossible;
As part of the legal warranty against hidden defects, ME UNLIMITED, at the Customer's choice and after assessing the defect, undertakes:
- Either to reimburse the entire price of the returned product;
- Or to refund part of the price of the product if the Customer decides to keep the product.

X. Force majeure
ME UNLIMITED shall not be liable for the total or partial non-performance of its obligations under this contract, if this non-performance results either from a Customer's action or an unforeseeable and insurmountable fact from a third party to the contract, or an event of force majeure as defined by the case law of the French courts, including in particular total or partial strikes, mainly concerning postal services and means of transport and/or communications. ME UNLIMITED shall notify the Customer of an event constituting force majeure within 5 working days of its occurrence. The Parties agree to consult as soon as possible to determine the procedure for processing the order for the duration of the event of force majeure. After a period of 30 days of interruption for force majeure, the Parties shall be released from their obligations towards each other. If applicable, ME UNLIMITED shall reimburse the Client as soon as possible.
XI. Dispute - Applicable law - competent courts
Mediation of consumer disputes: If the Customer has submitted a complaint to the Customer Service and the Customer has not been given satisfaction, the Customer may, in accordance with the provisions of the Consumer Code concerning amicable settlement of disputes, refer the matter to:

Online Dispute Resolution Platform: the European Commission has set up an Online Dispute Resolution platform to facilitate the out-of-court settlement of online disputes between consumers and professionals of the European Union. This platform is accessible at the following link: https://webgate.ec.europa.eu/odr/ These General Terms and Conditions of Sale and the contractual relations between ME UNLIMITED and the Customer are subject to French law. All disputes under the General Terms and Conditions of Sale, concerning their validity, interpretation, performance, termination, consequences and repercussions and which could not have been resolved between ME UNLIMITED and the Customer shall be submitted to the jurisdiction of the French courts, which shall have non-exclusive jurisdiction. Customers residing in another Member State of the European Union may also bring legal proceedings before the courts of the Member State in which they reside.
